Most restaurant owners don't realize that a new Massachusetts law permanently locks certain liquor licenses to a single address—and what that means for their business.
Most restaurant and bar owners in Massachusetts don't know that buried in S3234—a bill authorizing Millbury to grant additional liquor licenses—is a provision that permanently ties four of six new all-alcoholic restaurant and club licenses to one specific location. If you're considering opening or expanding in that area, this matters.
Section 1(b) of S3234 locks four of the six new all-alcoholic restaurant/club licenses to a single address: the Shoppes at Blackstone Valley, 70 Worcester Providence Turnpike in Millbury. These licenses cannot be relocated. Ever.
That means if you obtain one of these four licenses, you operate at that address for the life of the license. If you sell the business or the license changes hands, the next owner must also operate at the same location. The license stays with the property, not with the business operator.
The other two new licenses are not restricted to a specific address and can be used elsewhere in Millbury.
There's another layer. Any successor applicant seeking to take over one of these four location-locked licenses must first obtain clean tax compliance and unemployment insurance contribution letters from two state agencies before the license can be transferred. This adds a compliance gate that doesn't apply to unrestricted licenses.
If you own or operate a restaurant, bar, or club in or near Millbury and are considering one of these new licenses, you need to understand the location lock. You cannot build a business with the flexibility to relocate if circumstances change—market conditions, lease terms, or operational needs.
If you're a prospective buyer of an existing business at that shopping center holding one of these licenses, you'll need to plan for permanent operation at that site.
The act takes effect upon passage. The four location-locked licenses must be originally issued within two years of the effective date. After that window closes, no new licenses under this provision can be granted.

Location-locked licenses are uncommon and represent a real constraint on business flexibility. Before pursuing one of the four restricted licenses under S3234, weigh whether permanent operation at the Shoppes at Blackstone Valley aligns with your long-term business plan. The two unrestricted licenses offer more operational freedom, though they may be more competitive to obtain.
