A provision in AB1982 makes permanent what was supposed to be temporary—and it affects more California venues than many realize.
Most California gym and fitness studio owners don't realize that a provision buried in AB1982 may affect their licensing obligations. While the bill's headline focuses on drink lids and drug testing devices in bars, a critical change removes an expiration date that could reshape compliance costs for certain venues.
AB1982, chaptered on September 20, 2026, repealed the sunset date on a requirement that Type 48 licensees—bars open to the general public—must stock and sell drug testing devices and post a mandated notice about their availability. The original law included an expiration date of January 1, 2027. AB1982 removed that sunset, making the requirement permanent.
This change appears in Section 25624(b) of the bill and takes effect indefinitely, with no future end date.
Type 48 licenses are issued to bars and similar establishments open to the general public. If your fitness studio operates a bar, lounge, or similar on-premises drinking establishment that serves the general public—not just members—you likely hold a Type 48 license and are now subject to this permanent requirement.
Venues that are members-only, or that don't serve alcohol, are generally not affected. However, owners should verify their specific license type with the Department of Alcoholic Beverage Control (ABC) to confirm their obligations.
If you hold a Type 48 license, you must now:
This is an operational and financial commitment with no scheduled end. You'll need to budget for inventory costs, shelf space, staff training on the requirement, and ongoing compliance monitoring. Unlike the original law, which was set to expire, this obligation is now permanent.
The original sunset date of January 1, 2027, was intended to allow the state to evaluate the effectiveness of the drug testing device requirement. By removing that date, AB1982 signals that the legislature intends this to be a lasting policy, not a pilot program.
If you operate a Type 48 licensed venue, review your current compliance status. Confirm your license type with ABC, understand which drug testing devices meet state requirements, and ensure your staff knows the posting and sales obligations. If you're planning to open or modify a venue with alcohol service, factor this permanent requirement into your business plan and operating costs.
The Department of Alcoholic Beverage Control website provides guidance on Type 48 licenses and related requirements. For detailed, venue-specific compliance information, consult your ABC licensing representative or a business attorney familiar with California alcohol licensing.
